TERMS AND CONDITIONS
 

1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. In these Terms and Conditions, "Prize Supplier" means Luxury Escapes Travel Pty Ltd (ABN 16 150 650 927) of Level 4, 68 Clarke Street, Southbank 3006 Victoria and its related bodies corporate, trading as Luxury Escapes. The Prize Supplier is not the promoter of this promotion. The Prize Supplier supplies the Luxury Escapes account credit prize only and is not responsible for the conduct of this promotion, including entry, verification of entrants, the draw, prize allocation, prize notification or the delivery of any prize. Any claim, complaint or dispute concerning this promotion must be directed to the Promoter and not to the Prize Supplier.

3. Entry is only open to Australian residents aged 18 years and older.

4. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1^st cousin.

5. Entries into the promotion open at 9.00 AEDT on 1st November 2026 and close at 11:59PM AEDT on 30^th November 2026 (“Promotional Period”).

6. To enter, individuals must during the Promotional Period:

• purchase any Lavazza product from a participating Coles store or from Coles Online; an
• visit www.lavazza.com.au/en/winatcoles, follow the prompts to the promotion entry page, input the requested details (including first name, last name, email address, mobile phone number), upload a copy of the purchase receipt and submit the fully completed entry form.

7. Multiple entries permitted, subject to the following: (a) only one entry permitted per transaction regardless of the number of eligible products purchased in excess of one (1) in the qualifying transaction; and (b) each entry must be submitted separately and in accordance with entry requirements.

8. Only one (1) prize is permitted per person (excluding SA residents).

9. Entrants must retain their original Coles purchase receipts for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

10. The Promoter, reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

11. Incomplete, indecipherable, or illegible entries will be deemed invalid.

12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

13. The draw will take place at Level 9, 50 Queen Street, VIC 3000 on 2nd December 2026 at 10:00am. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing within two (2) business days of the draw and their first initial, surname and post code will be published at www.lavazza.com.au/en/winatcoles from 2nd December 2026. Winners will have 4 weeks to claim their prize.

14. The Promoter’s decision is final and no correspondence will be entered into.

15. The first two (2) valid entries drawn will each win a Luxury Escapes account credit to the value of $10,000 (each a "Credit"). To claim and use the Credit, the winner must have, or create, a Luxury Escapes account at https://luxuryescapes.com/au and must accept the Luxury Escapes website terms and conditions. The Credit is issued and supplied by the Prize Supplier. Use of the Credit is subject to the Luxury Escapes website terms and conditions (as amended from time to time) and to the following conditions:

(a) the Credit may be applied to the purchase price of "land only" Luxury Escapes packages and hotel offers only. The Credit cannot be applied to standalone flights, to any flight component of an accommodation and flights package, to gift cards, or to any third party fees, taxes or charges
(b) the Credit is applied at the time of booking. If the price of a booking exceeds the available Credit balance, the winner must pay the difference using an accepted payment method. For example, if the Credit balance is $200 and the booking costs $500, the winner must pay the remaining $300;
(c) any unused Credit balance remains in the winner's Luxury Escapes account and may be applied to further eligible bookings until expiry;
(d) the Credit expires 12 months after the date it is credited to the winner's Luxury Escapes account. Any unused balance at that time is forfeited and is not redeemable for cash;
(e) the Credit is not transferable or assignable, cannot be redeemed for cash, and cannot be used other than in accordance with this clause;
(f) all bookings made using the Credit are subject to availability at the time of booking and to the terms and conditions of the relevant offer. Neither the Promoter nor the Prize Supplier guarantees the availability of any particular offer, package, destination or travel date; and
(g) if the winner's Luxury Escapes account is cancelled or terminated in accordance with the Luxury Escapes website terms and conditions, any unused Credit balance is forfeited.

16. The next forty (40) valid entries drawn will each win one (1) Lavazza A Modo Mio Smeg Coffee machine $350 RRP each. Colour will depend on availability of stock at time of prize delivery and is not negotiable. There will be no returns or changes for colour preference. This prize will be sent to winners by post.

17. The next twenty (20) valid entries drawn will each win one (1) Coles voucher $250 each. Coles vouchers will be emailed to winning entrants. Full terms applicable to the use of Coles’ vouchers can be found at https://www.giftcards.com.au/giftcardtermsofpurchase

18. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

19. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

20. Total prize pool value is up to $39,000 AUD.

21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

22. A draw for any unclaimed prizes may take place on 15 January 2027 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) business days of the draw and their first initial, surname and post code will be published at www.lavazza.com.au/en/winatcoles on 18 January 2027. Second draw winners will have 14 business days from notification to claim their prize, before forfeiting.

23. Entrants consent to the Promoter and the Prize Supplier using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Prize Supplier (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion or out of the use of, or inability to use, any prize (including the Credit). The Prize Supplier's obligations in connection with this promotion are limited to issuing the Credit to the winner's Luxury Escapes account.

27. The Promoter collects your personal information (“PI”) including name, phone number, email address and membership details, when you enter this promotion for the purposes of administering the promotion. If the Promoter does not collect your PI, you will not be able to enter this promotion or claim your prize. The Promoter may disclose this information to third parties such as local lottery authorities and service providers assisting the Promoter with administering this promotion, for the purpose of conducting this promotion, including prize notification and fulfilment. The Promoter will disclose the winner's name, email address and contact details to the Prize Supplier for the purpose of creating or crediting the winner's Luxury Escapes account and fulfilling the prize. Personal information collected by the Prize Supplier is handled in accordance with the Luxury Escapes privacy policy available at https://luxuryescapes.com/au/privacy-policy.

28. The Promoter’s privacy policy can be found at https://www.lavazza.com.au/en/privacy-policy and contains information about how you may access and seek correction of your PI that the Promoter holds, how you may complain about a breach of the Australian Privacy Principles and how the Promoter will deal with such a complaint. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion, entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
